Glossary

Shop – the online shop run by polish-courses.com Iwona Stempek operating at the address: {shop address}, by means of which products are sold via the Internet;

Working days – all the days of the week from Monday to Friday, excluding public holidays;

Lead time – the time taken by the Store to complete an order and forward it to the carrier carrying out the form of delivery chosen by the Customer;

Customer – a natural person, legal person or organisational unit making purchases in the Shop and having a Customer Account;

Consumer – a customer who is a natural person, i.e. a natural person making a legal transaction with an entrepreneur which is not directly connected to his/her economic or professional activity;

Customer Account – a database containing the Customer’s data used to process placed orders and including, among others, order history, preferences, payment data;

Product – goods offered in the Store, both physical and non-physical (electronic);

Terms and Conditions – these terms and conditions for the provision of electronic services.

1. The shop sells products and services via the Internet.

2. Orders from customers are accepted through the Shop 7 days a week and 24 hours a day.

3. In order to make purchases in the Shop it is necessary to have an e-mail account.

4. Registration of a Customer Account is free of charge. In order to delete a Customer Account, it is necessary to inform the Shop in writing or by e-mail of the wish to delete it.

5. A contract of sale between the shop and a customer is considered concluded when the following conditions are fulfilled simultaneously:

a) the Store confirms the availability of the products ordered by the Customer

b) payment by the Customer of the order placed

6. By concluding a contract of sale with the Store and accepting the provisions of the Rules and Regulations, the Customer consents to the Store issuing an invoice in electronic form.

7. If an order has been paid for by the Customer and it is cancelled in whole or in part, the Store will make a refund in the amount of the value of the cancelled products or, if the whole order is cancelled, in the amount of the whole order.

8. If the order is not paid for within 7 days, the Shop will cancel the order by informing the Customer by e-mail. If the Customer pays for part of the order, the money paid will be refunded to his/her account number or card.

9. All product prices displayed in the Shop:

a) are given in PLN/EUR,

b) include VAT,

c) do not include delivery costs,

d) do not include costs related to possible customs duties.

10. Lead time is 2 working days from receipt of payment for the order.

The customer may choose the following forms of payment:

a) bank transfer

b) PayPal

c) Visa or MasterCard payment card

d) online bank transfer

e) Google Pay

f) BLIK

12. Delivery of the goods takes place in the manner chosen by the Customer and specified in the order. The following forms of delivery are available:

a) bank transfer

b) courier Fedex

c) courier DPD

d) InPost Paczkomat 24/7

e) ORLEN Paczka

The costs of delivery are automatically calculated each time depending on the selected form of delivery, the delivery address and the weight of the order. Only certain forms of payment or delivery may be available for selected products or delivery addresses.

13. Purchased electronic products for use on the e-polish.eu platform are provided in the form of a unique access code, which is sent to the email address provided when placing the order. This code allows access to the purchased materials and is sent automatically after the payment process is completed.

14. The Store is obliged to issue a product without defects. If a product is found to be defective, the Customer should electronically (by e-mail) describe the reasons for the complaint and then send back the defective product to the address of the Store. The Store will immediately, but no later than within 14 days of receiving the parcel with the defective product, respond to the complaint and inform the Customer about further proceedings.

15. In accordance with the applicable law, the Customer, who is a Consumer, may withdraw from the contract without giving any reason within 14 (fourteen) days from the date of receipt of the delivery. To do so, he must:

a) send a declaration of withdrawal;

b) return the product intact to the Store within 14 days at the latest, counting from the day on which he or she withdrew from the contract.

The Shop shall refund the returned product within 3 days from the date of receipt of the product from the Consumer or the provision by the Consumer of proof of its return, whichever event occurs first.

16. In the event that the package is returned to the sender due to the customer’s failure to collect it, a refund will be issued 14 days after the package is delivered back to the sender, with the deduction of shipping and return costs

17. In the event of circumstances obliging the Store to refund the amounts paid by the Customer to the Store, the refund will be made using the same method of payment as the one used by the Customer when making the payment for the order. The shop is not responsible for any failure to reimburse the amount due as a result of the customer providing incorrect personal details or an incorrect account number.

18. The Shop uses cookies to observe how the Shop is used. The Customer has the possibility of using the Shop without the use of cookies, but this may mean that some functions or services of the Shop will not work properly.

19. When using the Store, the Customer provides his/her personal data. The provision of personal data by a Customer is voluntary, but it is necessary in order to make purchases and use those services provided by the Store which require the provision of personal data. The administrator of the personal data is Iwona Stempek, who conducts business activity under the name Iwona Stempek polish-courses.com, with the registered office in Krakow 31-031, ul. Dietla 103, tel: info@e-polish.pl. Detailed information concerning the scope of personal data collected, the purpose and manner of its processing, as well as the Customer’s rights, is available in the privacy policy.

21. The provisions of Polish law, in particular the Civil Code, the Act on Consumer Rights and the Act on Provision of Electronic Services shall apply to matters not regulated in the Regulations.

22. The Terms and Conditions are effective as of 1 January 2019. The shop reserves the right to amend the Regulations. Orders placed before the effective date of changes to the Terms and Conditions are fulfilled on the basis of the provisions in force on the day the order was placed.
